HEELY BRAND TAKES STRONG STEPS AGAINST IMITATORS

The Heely brand is owned by Heeling Sports Limited ("HSL"), a US company based in Texas and distributed exclusively through Shiner Limited of Bristol to the UK and Northern Ireland.

With demand for these “wheeled trainers” exceeding expections, the market has already seen the introduction of cheap imitations. In order to protect the brand trademarks and patents, HSL and Shiner have warned off competitors through their solicitors and, where necessary, sued without hesitation. A court action against five sellers of imitation shoes resulted in injunctions being obtained against three of the Defendants, restraining them from any further trade. The remaining two Defendants agreed to give formal undertakings to the Court in similar terms to the injunctions which had been sought against them. One of these Defendants surrendered its entire remaining stock of 1,700 pairs of shoes to Shiner and the other agreed to put its remaining 400 pairs of shoes into the joint custody of the parties' solicitors. Further action has been taking recently against a company found to be trading in imitation shoes on the internet.
